Seit einigen Tagen tratscht die „hohe“ Gesellschaft über das unerwartete Ereignis – die L´oreal Erbin, Liliane Bettencourt, wurde entmündigt. Und das auf Wunsch ihrer Tochter. Auf Wunsch der TOCHTER, wurde der reichsten Frau Frankreichs ihr ältester ENKEL als Sachwalter zugestellt und ihre TOCHTER verwaltet ab jetzt ihre Finanzen. 

Ein Zitat auf nachrichten.at regt so manchen zum Nachdenken an: „ 'In Österreich lasse sich solch ein Antrag nicht leicht durchsetzen', sagt Familienrichterin Sabine Wimberger. 'Bei uns hat der Gesetzgeber Schranken eingebaut, um Missbrauch zu verhindern.' “ Kann man sich darauf verlassen?

Die 88-jährige Französin soll an Demenz leiden, da sie an Gedächtnis- und Bewusstseinsstörungen leidet, so der medizinische Gutachter. Ihr wurde vorgeworfen, von falschen Freunden ausgebeutet zu werden. Vor allem ist die Tochter wegen des besonderen Geschenks, des Künstlers François-Marie Banier misstrauisch. Dort soll ihre Mutter Milliarden aus ihrem Erbe für Gemälde, Immobilien, Lebensversicherungen und Schecks investiert haben.  Frau Bettencourt lässt sich jedoch nicht für alt und unfähig halten und kündigte gleich nach dem Bescheid an, dass es einen Einspruch geben wird. Sie sei vollkommen gesund und werde im Falle der Ablehnung ins Ausland gehen. Ein Verbot dafür, gibt es nicht, jedoch könnte dieser Versuch, wieder an Freiheit zu kommen, leicht an einem Umstand scheitern: die Kosten der Reise sollen durch den Sachwalter genehmigt werden.

Geld macht bekanntlich nicht glücklich. Von Eugen Schueller, dem Gründer von L´oreal, erbte die hohe Dame 27,5% der Aktien. Davon gehören 41,1% ihrer Tochter. Der zweitgrößte Aktieninhaber, der Frau Bettencourt buchstäblich in die Fußstapfen rückt, ist der Schweizer Lebensmittelkonzern Nestlé, mit 26,4% des Gewinnanteils. Letzterer kann erst dann weitere Prozente an dem französischen Konzern erwerben, wenn die gnädige Frau nicht mehr atmet. Gerüchte besagen, dass Frau Bettencourt vor zwei Jahren den Künstler, mit dem sie so großzügig war, als Erben eingesetzt hat. Diese ihre Entscheidung jedoch nach einem Jahr wieder rückgängig gemacht hat. In den letzten Jahren hat die reichste Frau Frankreichs ihren Schwiegersohn und Enkel mehr im Familienunternehmen eingesetzt.

Frau Bettencourt ist keine Ausnahme. Immer mehr Einträge werden gegen junge sowie alte Menschen gemacht, vor allem steigt die Prozentzahl der jungen Leute, die als psychisch krank, unzurechnungsfähig, unselbständig bezeichnet werden. Keiner nimmt sich die Zeit, sich mit den Leuten zu beschäftigen, die etwas mehr Aufmerksamkeit benötigen, die länger zum Nachdenken brauchen, nicht selbständig agieren. Jeder bleibt lieber egoistisch. Jeder, der sich mit seinen Fähigkeiten; Schnelligkeit, etc. außerhalb der „Norm“ befindet, wird in ein Heim, Krankenhaus „eingesperrt“ oder ihm wird die Möglichkeit genommen, für sich selbst und seine Finanzen zu entscheiden. Wie fühlt sich ein Mensch, der sein Leben lang erfolgreich war und über das eigene Geld die Entscheidungsmacht hatte, wenn ihm auf einmal das Recht genommen wird? Wie kann man es da vermeiden, dass man zu vegetieren beginnt?

 Ob ein Mensch zurechnungsfähig oder –unfähig ist, entscheidet ein Gutachter. Ein paar Stunden, oft sogar einige Minuten entscheiden, ob ein Mensch kompetent genug ist, um für sich selbst zu sorgen. Oft wird nicht einmal auf die Meinung des behandelnden Arztes Wert gelegt. Wie kann sich ein Mensch fühlen, wenn ein Wildfremder mit prüfendem Gesicht und verwirrenden Fragen auf einen losgeht? Was, wenn einer Prüfungsangst hat? Und dann noch die Frage: Warum soll Mann/Frau überhaupt irgendwelche komischen Fragen beantworten? Weil die Tochter auf ihre Mutter/ihren Vater eifersüchtig ist? Weil sie sich so ein Leben nicht gönnt oder über ihre Kindheitstraumas nicht hinwegkommt?

Liliane Bettencourt ist eine erfolgreiche, reiche Frau. Sie entscheidet für sich selbst, was sie macht, worin sie investiert etc. Ihr dieses Recht wegzunehmen bedeutet, nicht nur ihren Status niederzumachen, sondern ihr ganzes Leben in Frage zu stellen. Und danach soll sie es noch dulden, es sich antun, bei jemandem nachfragen zu müssen, ob sie sich das Leben leisten kann? Wie lebt ein Mensch, dem die Fähigkeit bzw. die Möglichkeit sein eigenes Leben nach dem eigenen Ermessen zu leben, weggenommen wird? Sollte er/sie dabei noch Freude empfinden? Glücklich sein? Nach welchen Kriterien wird über einen entschieden? Ist nicht der einzige Ausweg - Tod? Und wenn der Sachwalter noch dazu von der eigenen Tochter bestellt wird?
