Wundert Sie, dass Notare des Öfteren kriminell werden?
Notar Dr. Kralik als Verlasskommissär und Amtsperson verständigt die Dienstaufsicht nicht – warum?

Es sind die Selbstmorde von Notaren u.a. in Wien und der Steiermark bekannt, die Folge der Beteiligung derselben in betrügerische Handlungen waren.

Die Kronen Zeitung schreibt am 27. 5. 2014 über einen angeblich betrügerischen Notar.

Es ist nicht bekannt, dass zu 113_Hv_3_14_k des Landesgerichtes für Strafsachen Wien gegen em. Notar Dr. Lukanec wegen notarieller Handlungen ein Strafverfahren als Beitragstäter wegen betrügerischen Krida anhängig ist.

Es ist auch nicht bekannt, dass der Grazer Notar Dr. Homma rechtswidrig, rechtskräftig gerichtlich festgestellt, überhöhte Gebühren als Verlasskommissar in 1. Instanz sich zusprechen ließ.

Notar Dr. Stefan Kralik, 1180 Wien-Währing meldet weder der Dienstaufsicht des Bezirksgerichtes Döbling noch dem Oberlandesgericht Wien noch der Notariatskammer, dass das Bezirksgericht Döbling zu 2_A_307_13m seit Monaten einen gesetzlich umgehend zu bestellenden Verlasskurator nicht bestellt.

Die einzigen 3 Erklärungen des Notars Dr. Kralik als Amtsperson als Verlasskommissär zum Nachbar der keinen Lift einbauen kann, da die Baubehörde Magistrat Wien dem Verlass mangels Verlasskurator, die Nachbarin ist 2005, also vor 8 Jahren verstorben war, die Aufforderung zur Wahrung der Nachbarrechte im Bauverfahren nicht zustellen kann, waren:

1.    auszuziehen;

2.    er, Notar Dr. Kralik hätte in Kalksburg mit seinem Anwalt als Schüler Fußball gespielt;

3.    wenn man sich über eine Richterin beschwert, dann lässt diese den Akt monatelang liegen.

Das Landesgericht für Zivilrechtssachen Wien hat den Fristsetzungsantrag des Nachbarn am 12.2.2014 zu 42 FS1/14p, Eingang beim Bezirksgericht Döbling am 4.3.2014 abgewiesen und keine Säumnis des Gerichtes festgestellt. Es sei zulässig, dass die Verlasskuratorenbestellung entgegen den gesetzlichen Vorschriften monatelang dauert.  Das Landesgericht für Zivilrechtssachen Wien hat alle Parteien zur Sachlichkeit aufgefordert – mit dem Ergebnis, dass der Nachbar geduldig bis heute, weiter 3 Monate wartet, ohne dass die Richterin den zwingend gesetzlich vorgeschriebenen sofort zu bestellenden Verlasskurator bestellt hat und das mit Duldung Notars Dr. Kralik als Amtsperson als Verlasskommissär.

Hat Notar Dr. Kralik etwas zu verbergen, dass Notar Dr. Kralik als Amtsperson als Verlasskommissär duldend zusieht statt die Dienstaufsicht einzuschalten?

Es gilt für alle die Unschuldsvermutung.

Dass unter den Notaren diese Ämter (Notariate) „familienintern“ weitergegeben werden macht uns auf Kasachstan als Demokratie hinaufschauend, so tief ist kein anderes Land gesunken!
